2. Description of Service

ReadingFluency.app provides a web-based platform for reading fluency assessments, progress monitoring, and benchmarking. Features include passage generation, live classroom sessions, automated scoring (accuracy and words-per-minute), and data visualization for educational intervention.

3. User Accounts

  • Eligibility: The Service is intended for use by teachers, interventionists, literacy coaches, and educational administrators.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • Accuracy of Information: You agree to provide accurate and complete information when creating an account.

4. Use of the Service

  • Educational Purpose: You agree to use the Service solely for educational assessment and progress monitoring.
  • Compliance with Laws: You are responsible for ensuring your use of the Service complies with applicable local, state, and federal laws, including student privacy regulations (e.g., FERPA, COPPA).
  • Prohibited Conduct: You may not attempt to interfere with the Service's security, reverse engineer the platform, or use the Service for any unauthorized or illegal purpose.

5. Content and Data

  • User Content: You may upload or generate passages, notes, and rosters. You retain ownership of your content, but grant ReadingFluency.app a license to host and process this content to provide the Service.
  • Student Data: ReadingFluency.app facilitates the collection of student names (which may be masked), audio recordings, and assessment scores. This data is handled according to our Privacy Policy.
  • Data Portability: You may export assessment data and progress reports as provided by the Service's features.

6. Intellectual Property

All rights, title, and interest in and to the Service (excluding User Content) are and will remain the exclusive property of ReadingFluency.app and its licensors.

7. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or if we believe your actions may harm the Service or other users. You may close your account at any time by contacting support.

8. Limitation of Liability

The Service is provided "as is" and "as available." To the maximum extent permitted by law, ReadingFluency.app shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
